Legal Entity: These Terms of Service are entered into by and between you and Hustl LLC, a Tennessee limited liability company. Hustl LLC operates the Hustl marketplace platform.
Important: Hustl is currently designed for use only within the State of Tennessee. By using Hustl, you confirm that (a) you are at least 18, and (b) any jobs you post or perform through Hustl take place entirely in Tennessee.
1. Who We Are and What These Terms Do
These Terms of Service are entered into by and between you ("you," "user," "Customer," or "Hustler") and Hustl LLC, a Tennessee limited liability company ("Hustl," "we," "us," or "our").
Hustl is a marketplace platform that lets individuals and small businesses ("Hustlers") offer services to other users ("Customers") who need help with tasks such as hauling, moving, yard work, and similar jobs. Hustl itself does not perform these services and does not employ Hustlers.
By creating an account, accessing, or using Hustl in any way, you agree to these Terms and our Privacy Policy.
2. Tennessee-Only Service Area
Hustl is built to operate exclusively in Tennessee:
- Hustl is targeted only to Tennessee residents or people physically present in Tennessee.
- Jobs posted or performed through Hustl must be located entirely within Tennessee.
- We do not intend Hustl to be used in or directed to any other state or country.
If you access Hustl from outside Tennessee, you do so at your own risk and you are responsible for complying with local laws. Hustl may block or terminate accounts that appear to be using the platform outside Tennessee.
3. Eligibility
To use Hustl you must:
- Be at least 18 years old.
- Have the legal capacity to enter a contract under Tennessee law.
- Agree to these Terms and our Privacy Policy.
You may not use Hustl if you are barred from receiving services under the laws of the United States or Tennessee, or if your account has previously been suspended or terminated by Hustl.
4. Hustl's Role – Marketplace Platform Only
Hustl LLC operates Hustl as a neutral, third-party marketplace platform. Hustl LLC does not:
- Provide or supervise the services offered by Hustlers;
- Control how, when, or where Hustlers perform services;
- Guarantee any outcome of any job;
- Provide insurance, bonding, or a warranty for any service or Hustler;
- Act as a general contractor, employer, joint venturer, or partner of any Hustler.
Contracts for services are directly between Customers and Hustlers, even if they are created or recorded through the Hustl platform. Hustl LLC is not a party to these service contracts.
Hustl LLC may facilitate communication, provide tools to schedule jobs, and process payments through Stripe, but Hustl LLC is not a party to service contracts between users and has no control over the acts or omissions of any user.
5. Hustlers as Independent "Marketplace Contractors"
To the maximum extent allowed by Tennessee law, Hustlers using Hustl are intended to be treated as independent contractors, not employees of Hustl LLC. Tennessee recognizes "marketplace contractors" as a category of independent contractors who provide services through digital platforms.
Under Tennessee law, independent contractor status is supported where:
- There is a written agreement confirming independent contractor status (these Terms serve as that agreement);
- The platform does not control the manner and means by which services are performed;
- The worker is free to accept or decline work opportunities;
- The worker may use other platforms or engage in other work;
- The worker provides their own tools and equipment (where applicable);
- Payment is based on completed work, not time worked.
By signing up as a Hustler, you agree that:
- You are an independent contractor and not an employee of Hustl LLC for any purpose.
- You control when, where, and how you do jobs you accept, including your schedule and tools, subject only to what you agree with a Customer.
- You can accept or decline any job request.
- You are free to use other platforms and do other work at any time.
You are solely responsible for:
- Your own income, business, and employment taxes;
- Any required licenses, permits, or registrations;
- Insurance (e.g., general liability, auto, workers' comp, etc., if applicable);
- Any assistants or helpers you choose to bring for a job.
If you bring an assistant or subcontractor, you are solely responsible for paying them and making sure they follow these Terms and all applicable laws.
Nothing in these Terms should be interpreted as guaranteeing classification under any specific legal safe harbor, and classification determinations depend on the facts of each situation. You are responsible for seeking your own legal or tax advice.
6. User Accounts
You must create an account to use Hustl:
- You agree to provide accurate, current, and complete information.
- You are responsible for keeping your login credentials secure and for all activity that occurs under your account.
- You must promptly update your info (name, contact info, payment details) if it changes.
- We may, but are not required to, request ID verification or additional documents at any time and may suspend your account if we cannot verify necessary information. Any identity verification, if required, will be limited to what is reasonably necessary to prevent fraud or comply with applicable law.
7. Types of Users: Customers and Hustlers
- Customers: Post jobs, review offers, communicate with Hustlers, and pay through Hustl.
- Hustlers: Review available jobs, make offers, perform accepted jobs, and receive payouts through Hustl.
A single user can be both a Customer and a Hustler, but each role comes with its own responsibilities.
8. Jobs, Job Descriptions, and Prohibited Activities
8.1 Job Descriptions
Customers must:
- Provide clear, honest descriptions of the job;
- Disclose relevant risks (stairs, heavy items, special tools required, pets, etc.);
- Only post jobs they actually intend to pay for through Hustl.
Hustlers must:
- Carefully read job descriptions and ask questions before accepting;
- Only accept jobs they are capable and legally allowed to perform.
8.2 Prohibited Jobs and Uses
You may not use Hustl for:
- Any illegal activity or job;
- Jobs that require a license (e.g., certain electrical, plumbing, medical, or professional services) unless the Hustler holds all necessary licenses and permits;
- Jobs involving weapons, illegal substances, or dangerous materials;
- Adult or sexually explicit services;
- Fraudulent, deceptive, or misleading activity;
- Harassment, stalking, threats, or discrimination;
- Any use that violates these Terms or applicable law.
Hustl may remove job posts or suspend accounts at its sole discretion if we believe they involve prohibited or unsafe activity. However, Hustl does not guarantee that all prohibited jobs will be found or removed. You are responsible for making sure the job you offer or accept is lawful and safe.
9. Fees, Payments, and Stripe
9.1 Payment Processing
All payments on Hustl are processed through Stripe or a similar third-party payment provider. Your use of payments on Hustl is also subject to Stripe's own terms of service, privacy policy, and requirements, which may change over time.
Hustl LLC does not store your full credit or debit card numbers. Those are stored and processed by Stripe or another payment processor on our behalf.
9.2 Fees and Payment Structure
For each job paid through Hustl:
- Customer Service Fee: Customers pay a 6.5% service fee added to the job amount. For example, on a $100 job, the customer pays $106.50 total ($100 job amount + $6.50 service fee).
- Platform Fee: Hustl charges a platform fee deducted from the hustler's payout:
- 12% for Premium hustlers (hustlers with active Premium subscriptions)
- 15% for standard hustlers (non-Premium hustlers)
- Hustler Payout: The hustler receives the job amount minus the platform fee. For example:
- Premium hustler on a $100 job: receives $88.00 (12% platform fee = $12.00)
- Standard hustler on a $100 job: receives $85.00 (15% platform fee = $15.00)
- Tips: Tips are 100% passed through to hustlers with no platform fee deducted.
Example Payment Breakdown ($100 job with Premium hustler):
- Job Amount: $100.00
- Customer Service Fee (6.5%): +$6.50
- Customer Pays Total: $106.50
- Platform Fee (12%): -$12.00
- Hustler Receives: $88.00
- Platform Keeps: $18.50 ($12.00 platform fee + $6.50 service fee)
We may update these fees in the future. If we do, we will provide notice on the app or site, and the new fees will apply only to jobs accepted after the update.
9.3 Authorization and Holds
By hiring a Hustler, the Customer authorizes Hustl LLC (through Stripe) to:
- Charge the full job amount plus any applicable fees and taxes;
- Place a temporary hold on funds;
- Capture the payment once the job is marked complete, auto-completed, or resolved following a dispute process.
10. Job Completion, Disputes, and Auto-Release of Funds
10.1 Completion Flow
When a Hustler marks a job as completed in the Hustl platform:
- The Customer is notified and can:
- Confirm completion;
- Report a problem; or
- Request a reasonable revision (if both sides agree).
- If the Customer takes no action within a reasonable time (for example, 48–72 hours), Hustl may, but is not required to, treat the job as completed and instruct Stripe to release payment to the Hustler, minus Hustl's fees.
- Hustl may adjust the response window or apply different time windows for different job categories.
10.2 Disputes Between Customers and Hustlers
If a Customer reports a problem within the allowed time, Hustl LLC may request information from both sides (messages, photos, job details, receipts, etc.). In its sole discretion, Hustl LLC may:
- Release all or part of the payment to the Hustler;
- Refund all or part of the payment to the Customer;
- Hold funds while the parties resolve the issue; or
- Decline to intervene and let the parties resolve it independently.
Any decision Hustl LLC makes about funds held in the platform is final as between you and Hustl LLC. These decisions do not prevent either user from pursuing legal remedies directly against the other, as allowed by law.
9.5 Payment Terms for Customers
Payment Authorization: When you accept a Hustler's offer, you authorize Hustl to charge your payment method for the full job amount (including any applicable fees) through Stripe. This authorization is held in escrow until the job is completed.
Hourly Jobs: For hourly jobs, you authorize payment for the maximum estimated hours at the agreed hourly rate. You will only be charged for actual hours worked (up to the maximum), and any unused authorization will be automatically released after job completion.
Flat Rate Jobs: For flat rate jobs, you authorize payment for the full agreed-upon amount. Payment is captured once the job is marked complete and verified.
Add Hours (Hourly Jobs Only): If you need to add hours during an active hourly job, you can authorize an additional payment for the extra hours. The additional authorization follows the same escrow process as the initial payment.
Price Changes: If a price change is requested (by either party) and accepted, you must authorize the new payment amount before the change takes effect. The original payment authorization remains in escrow until the new amount is authorized or the original terms are finalized.
Payment Methods: Hustl accepts major credit cards and debit cards through Stripe. You must provide a valid payment method that can be authorized for the full job amount plus fees.
Failed Payments: If your payment method fails (expired card, insufficient funds, etc.), the job will be placed on hold until you provide a valid payment method. We will attempt to notify you of any payment issues.
9.6 Payment Terms for Hustlers
Payout Timing: You will receive payment after the job is marked complete by the Customer and verified, or after Hustl's auto-completion process (typically 48-72 hours after job completion if the Customer takes no action).
Stripe Account Required: You must connect and maintain a valid Stripe account to receive payouts. Payouts are sent directly to your connected bank account via Stripe Connect.
Payout Amount: You will receive the agreed job amount minus Hustl's platform fee (15% for standard hustlers, 12% for Premium hustlers). The platform fee is deducted before payout.
Hourly Jobs: For hourly jobs, you are paid for actual hours worked (up to the maximum authorized), calculated based on the timer that runs when you enter the start code and pause/resume functionality.
Disputes: If a Customer disputes a job or requests a refund, your payout may be delayed or adjusted. Hustl will review disputes and may release all or part of the payment based on the resolution.
Taxes: You are responsible for reporting all income received through Hustl to the IRS and paying applicable taxes. Hustl may provide tax forms (such as 1099 forms) if required by law.
9.7 Refund Policy
Refund Eligibility: Customers may request refunds for jobs that have not been completed, are incomplete, or do not meet the agreed-upon terms. Hustlers may also be eligible for partial payment if a job is partially completed but terminated early.
Refund Process:
- Before Job Starts: If a job is cancelled before work begins, Customers receive a full refund of the authorized amount (minus any applicable fees already processed).
- During Job: If a job is terminated mid-way, refunds are prorated based on work completed. For hourly jobs, Customers receive a refund for unused hours. For flat rate jobs, refunds are calculated based on percentage of work completed.
- After Completion: Refunds after job completion are subject to dispute resolution. Customers must contact Hustl support within 48 hours of job completion to initiate a refund request.
Dispute Resolution for Refunds: If you request a refund, Hustl will review the request and may:
- Release the full payment to the Hustler if the job was completed as agreed;
- Refund the full amount to the Customer if the job was not completed or significantly differed from the agreement;
- Prorate the payment and refund based on work completed;
- Request additional information from both parties to make a determination.
Refund Timeframe: Refunds are processed within 5-10 business days after approval. The refund will appear on your original payment method within 1-2 billing cycles, depending on your bank or card issuer.
Non-Refundable Fees: Hustl's platform fee is generally non-refundable, except in cases where Hustl determines that the refund is due to platform error or technical issues.
How to Request a Refund: To request a refund, contact Hustl support at team.hustlapp@outlook.com with:
- Your job ID and details;
- Reason for refund request;
- Supporting documentation (photos, messages, etc.);
- Your preferred resolution.
Unused Authorization Release: For hourly jobs, any unused payment authorization (for hours not worked) is automatically released back to your payment method after job completion, without requiring a refund request.
Chargebacks: Instead of filing a chargeback with your bank or card issuer, please contact Hustl support first. Chargebacks may result in account suspension and Hustl will work with you to resolve disputes through our internal process.
11. Payments Outside the Hustl Platform
All jobs found or arranged through Hustl must be paid through Hustl, unless we give specific written permission otherwise.
You agree not to:
- Request, suggest, or accept off-platform payment to avoid Hustl's fees;
- Pay or get paid in cash, personal apps, or other methods for a Hustl job.
If you choose to bypass Hustl and pay off-platform anyway, you do so entirely at your own risk. Hustl LLC has no responsibility for disputes, losses, injuries, chargebacks, or damages arising from off-platform payments. We may suspend or terminate accounts that attempt to avoid Hustl's payment system.
12. Taxes
Hustlers and Customers are solely responsible for:
- Determining if any sales, use, or other taxes apply to a job under Tennessee law;
- Collecting and remitting any applicable sales tax if required by Tennessee law (Customers may be responsible for sales tax on services in certain circumstances);
- Reporting and paying all applicable federal, state, and local taxes (including income and self-employment taxes);
- Maintaining records of all transactions for tax purposes.
Hustl LLC is not responsible for payment disputes beyond platform facilitation. Payment processing is handled by third-party payment processors (e.g., Stripe), and Hustl LLC's role is limited to facilitating transactions through the platform.
For Hustlers: As independent contractors, you are responsible for:
- Paying self-employment taxes (Social Security and Medicare) on your earnings;
- Making estimated tax payments if required;
- Keeping detailed records of all jobs, payments, and expenses;
- Filing appropriate tax returns with the IRS and Tennessee Department of Revenue.
For Customers: You may be responsible for:
- Sales tax on services if applicable under Tennessee law (consult a tax professional);
- Reporting payments made to hustlers if you meet certain thresholds (generally $600 or more per year to a single hustler).
Hustl LLC does not provide tax advice. We may, but are not required to, issue tax forms (such as 1099-NEC forms) through Stripe or another provider if you meet IRS reporting thresholds. You should consult with a qualified tax professional to understand your specific tax obligations under federal and Tennessee law.
13. Reviews, Ratings, and User Content
Customers and Hustlers may leave ratings and written reviews. By posting reviews or other content (photos, text, profile info), you grant Hustl LLC a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, display, and distribute that content for operating and promoting the platform.
You agree that your content will:
- Be accurate and based on your genuine experience;
- Not be defamatory, hateful, harassing, or otherwise unlawful;
- Not violate any third-party rights (privacy, confidentiality, IP, etc.).
Hustl LLC may remove or edit content at its discretion but is not obligated to police every review.
14. Safety; No Background Checks or Insurance
Hustl LLC does not guarantee the identity, background, criminal history, driving record, insurance status, or qualifications of any user. We may offer optional checks or verification steps, but you should not rely solely on them.
You are responsible for your own safety:
- Meet in safe, public or visible locations where possible;
- Use common sense and your judgment before allowing someone into your home or vehicle;
- Ask questions about tools, vehicles, and experience;
- Consider seeking your own legal advice and maintaining your own insurance.
Hustl LLC does not provide or arrange liability insurance, workers' compensation, property coverage, or any other insurance for jobs.
15. Acceptable Use
You agree not to:
- Use Hustl in any way that could damage, disable, or impair our systems;
- Access or attempt to access accounts that are not yours;
- Interfere with other users' use of the platform;
- Use automated tools (bots, scrapers) without written permission;
- Reverse engineer or attempt to obtain the source code of Hustl;
- Use Hustl to send spam, phishing, or fraudulent messages.
We may monitor use of Hustl to protect our systems and users and may suspend or terminate accounts that violate this section.
16. Third-Party Services
Hustl integrates with third-party services to operate the platform, including:
- Payment Processors: Stripe and similar payment processors handle all payment transactions. Your use of payments is subject to Stripe's terms of service and privacy policy.
- Database and Cloud Hosting: Secure cloud database and hosting providers store platform data and user information.
- File Storage: Cloud storage services securely store photos and documents uploaded by users.
- Analytics and Security Tools: Services that help us understand platform usage and protect against fraud and security threats.
- Mapping/Location Services: Services that help with location-based features and job matching.
Those services have their own terms and privacy policies. Hustl is not responsible for the actions, omissions, or policies of third-party providers, even if we use or recommend them. However, we select providers that meet industry standards for security and data protection.
17. Intellectual Property
All rights in the Hustl platform (code, design, logo, trademarks, content we create) are owned by Hustl LLC or its licensors. You receive a limited, non-exclusive, revocable license to use Hustl for personal or internal business purposes, in compliance with these Terms.
You may not:
- Copy, modify, or create derivative works based on Hustl;
- Use our trademarks or branding without written permission;
- Resell or commercially exploit Hustl (other than performing services as a Hustler).
18. Disclaimer of Warranties
HUSTL IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
Without limiting the generality of the above, we do not warrant that:
- The platform will be uninterrupted, secure, or error-free;
- Any job, user, or service will meet your expectations;
- Content or information on Hustl is complete, accurate, or current.
You use Hustl and interact with other users at your own risk.
19. Limitation of Liability
To the maximum extent allowed by Tennessee law:
HUSTL LLC AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING LOSS OF INCOME, PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES.
HUSTL LLC IS NOT LIABLE FOR ANY ACTS OR OMISSIONS OF CUSTOMERS, HUSTLERS, OR OTHER THIRD PARTIES, INCLUDING PERSONAL INJURY, PROPERTY DAMAGE, OR OTHER HARM CAUSED DURING OR RELATED TO JOBS ARRANGED THROUGH THE PLATFORM.
In any case, Hustl LLC's total aggregate liability to you for all claims arising out of or relating to the platform will not exceed the greater of:
- The total platform fees you paid to Hustl in the 12 months before the event giving rise to the claim; or
- $100 (one hundred U.S. dollars).
Some limitations may not apply if prohibited by law, but because Hustl is Tennessee-only, these limitations are intended to be enforceable under Tennessee law.
20. Indemnification
You agree to indemnify, defend, and hold harmless Hustl LLC and its owners, officers, employees, contractors, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of Hustl;
- Your violation of these Terms;
- Your violation of any law or third-party rights;
- Any job you post, perform, or participate in.
21. Changes to the Platform and Terms
We may update or change Hustl, including features, and we may update these Terms from time to time. When we make material changes, we will post the updated Terms with a new "Last updated" date and may provide additional notice (e.g., in-app or email).
If you continue to use Hustl after the updated Terms go into effect, you are agreeing to them. If you do not agree, you must stop using Hustl and close your account.
22. Dispute Resolution with Hustl; Arbitration; No Class Actions
If you have a dispute directly with Hustl (not just another user), you agree to follow this dispute resolution process:
22.1 Informal Resolution
- First, email us at team.hustlapp@outlook.com with a brief written description of your dispute, including your account information and the nature of the issue.
- Allow 30 days for informal resolution efforts. We will make a good faith effort to resolve your dispute during this period.
22.2 Binding Arbitration
If we cannot resolve the dispute informally within 30 days, then, except for claims that may be brought in small-claims court (claims under $25,000), you and Hustl agree to binding, individual arbitration under the following terms:
- Arbitration Provider: The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, or by another mutually agreed-upon arbitration provider.
- Location: The arbitration will take place in Williamson County, Tennessee, unless we both agree to another location or a remote/virtual process.
- Arbitrator Authority: The arbitrator may award any relief a court could award, including monetary damages and injunctive relief, except that the arbitrator may not award class-wide or representative relief.
- Costs: Each party will bear their own attorneys' fees and costs, unless the arbitrator determines that a party's claim or defense was frivolous or brought in bad faith, in which case the arbitrator may award fees to the prevailing party.
- Confidentiality: The arbitration proceedings will be confidential to the extent permitted by law.
22.3 No Class Actions
You and Hustl agree that each may bring claims only in your individual capacity, not as a class member or representative in any class, collective, or representative action or proceeding. This means:
- You may not join your claims with those of other users;
- You may not participate in a class action lawsuit against Hustl;
- Any arbitration will be conducted on an individual basis only.
If any part of this class-action waiver is found unenforceable for a particular claim under Tennessee law, that claim (and only that claim) must be brought in a court of competent jurisdiction in Williamson County, Tennessee, and not in arbitration. All other claims remain subject to arbitration.
22.4 Exceptions
The following types of claims are NOT subject to arbitration and may be brought in court:
- Small claims court actions (claims under $25,000);
- Claims for injunctive or equitable relief to stop intellectual property infringement or unauthorized use of the platform;
- Claims that are required by law to be resolved in court (if any).
23. Governing Law and Venue
These Terms and any disputes between you and Hustl are governed by the laws of the State of Tennessee, without regard to conflict-of-law rules or principles that would apply the laws of another jurisdiction.
This includes:
- Tennessee contract law for interpretation of these Terms;
- Tennessee tort law for any claims of negligence or other torts;
- Tennessee consumer protection laws;
- Federal law where applicable (such as federal arbitration law, federal tax law, and federal employment law).
Subject to the arbitration provisions in Section 22, any permitted court proceedings must be brought exclusively in the state or federal courts located in Williamson County, Tennessee. You consent to the personal jurisdiction and venue of those courts and waive any objection to venue or jurisdiction based on inconvenient forum or similar grounds.
If you are a Tennessee resident, this choice of law and venue is intended to be convenient for you. If you are not a Tennessee resident but use Hustl, you agree to this choice of law and venue as a condition of using the platform.
24. Entire Agreement and Miscellaneous
These Terms and the Privacy Policy constitute the entire agreement between you and Hustl LLC regarding your use of the platform. They supersede all prior agreements, understandings, or communications, whether written or oral, relating to the subject matter of these Terms.
24.1 Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable under Tennessee law, that provision will be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, it will be severed from these Terms. The remaining provisions will remain in full force and effect.
24.2 Waiver
Hustl LLC's failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision. Any waiver must be in writing and signed by Hustl LLC to be effective.
24.3 Assignment
You may not assign or transfer these Terms or your account to another person without Hustl LLC's prior written consent. Hustl LLC may assign these Terms or transfer our rights and obligations to a third party (such as in a merger, acquisition, or sale of assets) without your consent, provided that your rights under these Terms are not materially diminished.
24.4 Force Majeure
Hustl LLC is not liable for any failure or delay in performance under these Terms due to circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, labor disputes, internet or telecommunications failures, government actions, or other force majeure events.
24.5 Survival
Certain provisions of these Terms will survive termination of your account or these Terms, including: Sections 9 (Fees and Payments), 12 (Taxes), 13 (Reviews and Content), 17 (Intellectual Property), 18 (Disclaimer of Warranties), 19 (Limitation of Liability), 20 (Indemnification), 22 (Dispute Resolution), and 23 (Governing Law).
